BETTERTECH Privacy Statement.

Welcome to BETTERTECH.
Please read this Privacy Policy carefully in order to inform yourself and agree to the collection of your personal data.

1. Introduction

Protecting the privacy of individuals on the Internet is fundamental to the future of Internet-based business and to advancing towards a true Internet economy. We have created this Privacy Policy to demonstrate our full commitment to individuals' right to privacy. This Privacy Policy summarizes our practices regarding the processing of information that may be used to identify, directly or indirectly, an individual ("Personal Data").

Some third-party offers/services included in Bettertech programs and/or Web pages may have their own, and possibly different, privacy statements. We therefore recommend that you read the privacy statements of each of the Web pages, offers or services that you may visit or review.

This Privacy Policy applies to all Bettertech institutional sites and platforms used by its customers.

The data controller is Bettertech – A.I.S.I. Lda., at Praça do Comércio, 14 – 3000-116 – Coimbra – Portugal.

With regard to Bettertech's institutional sites, Bettertech acts as Data Controller of the Personal Data collected. With regard to the software platforms made available to and used by its Customers, Bettertech typically acts as a Data Processor, processing Personal Data on behalf of and under the instructions of the Customer (Data Controller), under the terms defined in the applicable contract or Data Processing Agreement (DPA) entered into with the Customer.

Global Basic Privacy Principles

Our privacy practices expressed here reflect current global principles and standards on the processing of personal data. These principles include data access, data integrity, security, onward transfer and enforcement. We abide by the privacy laws in force in the countries where we operate.

Consent

By using this Web page, you are giving your consent to the collection and use of your Personal Data, as described herein. If you do not agree with the terms set out here, please do not use this Web page.

If we decide to change this Privacy Policy, we will disclose such changes on this page, so that you are always informed about the type of Personal Data we collect and how it will be used. Therefore, we recommend that you periodically check for updates to this Privacy Policy.

Depending on what may be required by applicable law, we may ask you to explicitly authorize the processing of certain Personal Data collected on this Web page or provided by you. Please note that any consent will be entirely voluntary. However, should you not grant the requested consent regarding the processing of your Personal Data or, in accordance with the chapter on Data Retention below, subsequently inform Bettertech that you do not wish us to continue processing your Personal Data, continued use of certain BETTERTECH offers or services may not be possible or may be limited in scope.

2. Collection and Processing of Personal Data

To better serve you and understand your needs and interests, BETTERTECH may collect, export and use Personal Data with notice (as stipulated herein) and, where legally required, appropriate consent, in addition to the necessary requirements with data protection authorities, where applicable.

Depending on the purpose in question, the processing of Personal Data relies on one of the following legal bases provided for in the GDPR: (i) performance of a contract or pre-contractual steps taken at the data subject's request; (ii) compliance with legal obligations to which BETTERTECH is subject, namely tax and accounting obligations; (iii) the data subject's consent, namely for e-mail marketing purposes; or (iv) BETTERTECH's legitimate interest, namely in the management and security of its information systems.

When you visit our Web page(s), we may record your IP address and use cookies, as well as other Internet technologies (referred to below as "Automatic Tools" and "Embedded Web Links"), which allow us to collect general information about our visitors and their interests. Depending on the Automatic Tools used, the data collected includes, in addition to your IP address, the cloud identity we assign to you when you access BETTERTECH Web pages, the type of browser you use, the BETTERTECH Web pages you visited, the objects you clicked on a given BETTERTECH Web page, the time you spent on a given Web page, the referring Web page from which you accessed a BETTERTECH Web page, and the external destination Web page you accessed from a BETTERTECH Web page.

We may also collect and process any Personal Data that you voluntarily provide to us. For example, when registering/activating vouchers or other BETTERTECH offers, subscribing to newsletters, participating in surveys, discussion groups or online forums, or otherwise sending your contact details to BETTERTECH.

Such Personal Data may include your first and last name, your postal and e-mail address, your telephone number, financial and banking data relevant to processing a Purchase Order, and certain information about the company you work for (for example, the company's name and address), as well as information about your relationship with BETTERTECH.

3. Use and Purpose of the Personal Data Collected

The information that BETTERTECH collects to understand your needs and interests helps BETTERTECH provide you with a consistent and personalized experience. We will only use this information in accordance with what is described in this Policy or as indicated at the time of collection. Accordingly, the way your Personal Data is used will not be changed without your prior consent, in accordance with applicable law. We will use your Personal Data exclusively for the following purposes:

To process orders and provide the products, services and information you requested;
To provide a personalized user experience and display protected content;
To allow us to contact you in response to your inquiries, and to send you shipping and billing information.

4. E-mail Addresses

If you choose to provide us with your e-mail address, we will communicate with you by e-mail. We will not share your e-mail address with other companies. You may opt out of receiving e-mails at any time (in accordance with the chapter on the Opt-out Option below). However, this option will not affect the sending of e-mails strictly necessary for the business relationship between you and BETTERTECH.

Depending on your e-mail application settings, your personal information may be transmitted automatically when you send an e-mail to BETTERTECH.

5. Purchases, Event Registration or Voucher Activation

Our page may include order or activation forms, which are filled in to request information, products and services. These forms may collect financial information, such as your bank account details (IBAN), in addition to the information mentioned above. BETTERTECH undertakes to use the financial information you provide only for billing and payment purposes for that specific transaction. This may include transmitting your data to third parties involved in carrying out the transaction, such as banks, credit institutions, payment intermediaries and other financial and credit control institutions.

6. IP Addresses

We use IP addresses to help diagnose problems, determine the country from which a user is using our pages and services in order to provide the appropriate legal statements, administer such pages, and collect demographic information.

We may also use IP addresses or other information you have shared on this Web page or on previous occasions, or a campaign code, to determine which areas of our pages you have visited and which topics are of interest to you, so that we can provide you with relevant product and service information.

BETTERTECH may also collect IP addresses (and other technical information, such as browser type). This information is collected when the user connects to BETTERTECH, so that we can identify your session, provide content based on your browser's technical capabilities, and for quality control purposes. The IP address will not be used to identify you.

BETTERTECH only collects information relating to your visit to our pages. BETTERTECH does not control or collect Personal Data from your visits to other companies or entities, other than those mentioned in the "Collection and Processing of Personal Data" section.

7. Automated Resources with Third-Party Cookies

In addition to the information provided, BETTERTECH may also collect information during your visit to a BETTERTECH Web page through Automated Resources, which may include cookies, embedded Web links and other information-gathering tools commonly used by third parties. These resources collect certain standard information that your browser sends to our Web page, such as browser type and language, access times, and the address of the Web page from which you arrived at a BETTERTECH Web page.

To select which cookies to allow, BETTERTECH provides the CookieBot Consent Manager (https://www.cookiebot.com/), which complies with the European Directive on Cookie policy and is already compatible with version 2 of Google's consent management. To review this consent, you can always click the respective link on the icon located in the bottom-left corner of the Web page.

If the CookieBot Manager is not available, you can select the appropriate settings in your browser. Please note that, in this case, your browser's cookie settings are limited to the specific browser installed on a specific device, and that, as a result, if you visit BETTERTECH Web pages with different browsers or different devices, you will need to disable control cookies on each of them. However, please note that doing so may prevent you from using the page's full functionality.

Google Analytics

Some Web pages that reference this Privacy Policy use Google services, such as Google Analytics and Google Ads. These use cookies, which are text files placed on your computer to help the Web page analyze how users use the page. The information generated by the cookie about your use of the Web page (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information to evaluate your use of the Web page, compile reports on page activity for Web page operators, and provide other services relating to page activity and Internet usage.

Google may also transmit this information to third parties, where required to do so by law or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.

In addition to opting out through the CookieBot Consent Manager, Google has developed the Google Analytics Opt-out Browser Add-on, available at: Google Analytics Opt-out Browser Add-on.

Bettertech uses Google Analytics only on its institutional pages, such as the sites bettertech.pt, bettertechsoftware.com, blog.bettertechsoftware.com and other similar sites. It does not use Google Analytics on any of its Web or mobility platforms or applications.

Embedded Web Links

BETTERTECH e-mails often use links designed to direct you to a relevant area of the Web or the platform in use. The redirection system allows BETTERTECH to change the destination URL of these links, if necessary, and to determine the effectiveness of our marketing initiatives.

In e-mails, these links may also allow BETTERTECH to determine whether you clicked on a link in the e-mail, and information about this interaction may be associated with your personal identity. If you do not want BETTERTECH to collect information about the links you clicked on, you can simply choose not to click on the links in an e-mail sent by BETTERTECH.

Cookies

Cookies are identifiers that can be sent from a Web page through your browser, to be placed on your computer's hard drive. BETTERTECH uses cookies to provide personalized content, so that you do not have to re-enter your password or fill in registration forms repeatedly, and to tailor our information offering to how the Web page is used by you and others.

The use of cookies on BETTERTECH's Web platforms only stores information about the session established between a workstation and the server, and only while that session is active.

Your choice regarding BETTERTECH's use of cookies:

When you first access Bettertech's Web sites, a banner is shown with information about accepting the use of cookies. If you do not wish to accept full use of cookies, select the option that best suits you.
You may refuse the use of cookies by selecting the appropriate settings in your browser. Please note that your browser's cookie settings are limited to the browser installed on a device and, as a result, if you visit BETTERTECH Web pages with different browsers or different devices, you must disable cookies in the browsers of all relevant devices. Also note that if you disable cookies, you may not be able to use the full functionality of a Web page.

8. Sharing of Personal Data

BETTERTECH operates several Web pages in various parts of the world. All data and information that you voluntarily provide to us, or that is otherwise collected on one of our Web pages in any country, may be sent electronically to a server of one of those Web pages in another country. Such servers or other types of data processing facilities may be located inside or outside the European Economic Area or in third countries considered by the European Commission to provide an adequate level of data protection. However, we safeguard your right to privacy worldwide, ensuring that this BETTERTECH Web page complies with our data protection principles, described in this statement.

Whenever Personal Data of data subjects located in the European Economic Area is transferred to a third country that does not benefit from an adequacy decision of the European Commission, BETTERTECH ensures the existence of appropriate safeguards required by the GDPR, namely through Standard Contractual Clauses approved by the European Commission or another legally permissible international transfer mechanism.

We may also share this information with duly authorized business partners, service providers, agents or external contractors (such as, for example, SendinBlue/Brevo/SMTP2GO, IfThen Software), for the provision of a specific service or transaction, including the processing of orders or credit/debit card operations, receiving event registrations and providing customer support, or to analyze user behavior on our Web pages (for example, in the case of Google Analytics) or the results of sending Newsletters (for example, Brevo).

We only provide these third parties with the minimum Personal Data necessary to provide services on our behalf, and such third parties (where legally required) are bound by appropriate data processing agreements and/or comprehensive confidentiality agreements, and are therefore not authorized to use your Personal Data except for the limited purpose of completing the requested service or transaction.

We do not sell or rent your Personal Data to third parties for marketing purposes.

If necessary, we may respond to subpoenas, court orders or judicial proceedings by disclosing your Personal Data or other related information. We may also choose to establish or exercise our legal rights or defend ourselves against legal claims.

Situations may arise in which, for strategic or business reasons, BETTERTECH decides to sell, buy, merge or reorganize its company. Such transactions may involve, in accordance with applicable law, the disclosure of Personal Data to potential or actual buyers, or the receipt of such data from sellers. It is BETTERTECH's policy to seek adequate protection for information in these types of transactions.

We may collect and share Personal Data, as well as any other additional information provided to us, in order to investigate, prevent or take action regarding illegal practices, suspected fraud, situations involving potential threats to the physical integrity of any person, violations of BETTERTECH's terms of use, or any other situation provided for by law.

9. Security of Personal Data

BETTERTECH is committed to protecting the Personal Data you share with us. BETTERTECH uses a combination of security technologies, procedures and industry-standard organizational measures to help protect your Personal Data from unauthorized access, use or disclosure. BETTERTECH supports online security through the use of secure server technology because we want your data to be safe. State-of-the-art security provisions and facilities exist on BETTERTECH's Web pages in order to prevent abuse.

Our employees are contractually required to respect your privacy and confidentiality rights.

10. Links to Other Web Pages

BETTERTECH's pages may contain links to external Web pages (for example, references to strategic partnerships). BETTERTECH is not responsible for the privacy practices or content of Web pages that do not belong to the BETTERTECH group of companies. We therefore recommend that you carefully read the privacy statements of such external Web pages.

11. Opt-out Option

We communicate by e-mail with users who subscribe to our services, and we may also communicate by phone to handle customer complaints or investigate suspicious transactions. We may use your e-mail address to confirm the opening of an account or a user, or to send you payment notices, information about changes to our products and services, as well as notifications and other publications required by law. Generally speaking, users cannot opt out of these communications, which are not related to marketing and are simply necessary for the relevant business relationship and for the normal use of BETTERTECH's platforms and applications.

With regard to marketing-related communications (for example, e-mails and/or phone calls), BETTERTECH provides an opt-out link from marketing lists, giving you the opportunity to opt out if you do not wish to receive further marketing-related communications from us.

If you receive marketing or similar messages by e-mail from us and wish to opt out of receiving such messages, simply follow the opt-out procedure indicated in the e-mail. In addition, you may opt out of receiving future marketing or similar messages by sending an e-mail to rgpd@bettertechsoftware.com, with your request to unsubscribe.

12. Data Retention

BETTERTECH will not retain your Personal Data for longer than necessary to fulfil the purpose for which it was collected, or for longer than required by applicable law or regulations. In particular, and provided there is no conflicting legal obligation, BETTERTECH will delete your Personal Data as soon as it is informed that you do not want BETTERTECH to continue processing your Personal Data. Please send any such request to rgpd@bettertechsoftware.com. Please note that, in this case, the use of certain services or offers may be limited or no longer available. Should there be a conflicting legal obligation for BETTERTECH to retain your Personal Data, BETTERTECH will block that data from further processing and will delete the relevant Personal Data once the retention requirement has ceased.

13. Inquiries, Access and Update of Your Personal Data

BETTERTECH needs your help to keep the Personal Data you shared with us accurate and up to date. If you are a registered Newsletter user, you can update your own data online via this link. You may also make these updates or other changes by sending an e-mail to comercial@bettertechsoftware.com.

In accordance with national Personal Data Protection Law and the GDPR, the data subject has, namely, the following rights:

Right of access: to know what Personal Data is processed by BETTERTECH and to obtain a copy of it;
Right to rectification: to correct or complete incomplete, incorrect or outdated data;
Right to erasure ("right to be forgotten"): to request the deletion of Personal Data, where applicable;
Right to restriction of processing: to request the temporary suspension of processing, in the cases provided for by law;
Right to data portability: to receive your Personal Data in a structured format and transmit it to another data controller;
Right to object: to object, at any time and on grounds relating to your particular situation, to the processing of your Personal Data, including for direct marketing purposes;
Right to withdraw consent at any time, without affecting the lawfulness of processing carried out based on consent previously given;
Right to lodge a complaint with a supervisory authority: in Portugal, the Comissão Nacional de Proteção de Dados (CNPD), via www.cnpd.pt, or with the competent supervisory authority in your country of residence.
